Regulations for the provision of waste disposal services by DKM Property Sp. z o.o. Sp. k.
§ 1. Definitions
The meaning of terms used in the Regulations:
- Client — a natural person, legal person or organizational unit that is not a legal person, whose regulations they specifically confer the legal capacity of the party placing the Order.
- Service — a service consisting in collecting waste from the Client in KP-5, KP-7, KP-10 and KP-15 containers, owned by the Service Provider.
- Civil Code — the Act of April 23rd, 1964 (Journal of Laws No. 16, item 93, as amended).
- Consumer — a Client who is a consumer within the meaning of art. 22 (1) of the Civil Code.
- Service Provider — DKM Property Sp. z o.o. Sp. k. with headquarters in Warsaw, ul. Syta 66A, 02-993 entered into register of entrepreneurs kept by the District Court for the Capital City of Warsaw, XIII Economic Department Of the National Court Register under the number KRS 0000364054, NIP: 9512321522.
- Agreement — an agreement for the provision of services within the meaning of the Civil Code, concluded between the Service Provider and the Client.
- Regulations — these Regulations for the provision of waste disposal services.
- Order - Client's declaration of will, which is also the conclusion of the Agreement between the Service Provider and The Client, specifying in particular the type of service.
§ 2. General rules
- These Regulations define the rules for submitting Orders for the disposal of waste by DKM Property Sp. z o.o. Sp. k.
- The condition for submitting an Order by the Client is to read these Regulations and accept its provisions.
- The Service Provider:
- offers its Services in the field of construction waste removal in mulda (2.5), KP-5, KP-7, KP-10 and KP-15 containers, owned by the Service Provider, and in Bigbag bags
- has the appropriate qualifications and authorizations to perform the work that is the subject of the contract and is responsible for waste management in accordance with applicable regulations
- delivers and sets up containers at a location agreed by both parties
- only collects waste in provided containers or Big Bags
- Client:
- takes full responsibility for the containers rented from the Contractor and for their use in accordance with their intended purpose.
- undertakes to cover the costs of a new container in the event of improper use of the container, e.g. burning waste in it, storing salt, lime, etc.
- undertakes to indicate a place for the container to be parked and to obtain the appropriate permits and pay fees, including the right-of-way occupation. The legal consequences resulting from placing the container in an incorrect place are the responsibility of the Client
- ensures proper access to the container, free from snow and ice and not blocked by other vehicles
- The maximum time for loading the container is 7 days. In special cases, this time can be extended for an additional fee.
- The container is filled to the height of the sides, in the case of oversized loading, the Client is obliged to partially unload it on their own.
§ 3. Placing orders and payments
- Orders are accepted via the website or by phone.
- Orders placed via the website can be placed 24 hours a day, 7 days a week throughout the year.
- The order is effective if the Client correctly completes the Order form and provides contact details, including the exact address where the container is to be delivered, as well as the telephone number and e-mail address.
- In the event that the provided data is not complete, the Service Provider will contact the Client. If it is not possible to contact the Client, the Service Provider has the right to cancel the Order.
- Orders placed by phone at 600-47-47-48 or 608-750-011 are accepted from Monday to Friday from 7-18, and on Saturdays from 7-14.
- In the case of online orders, delivery of BigBag bags in the Warsaw region is carried out by the courier company InPost. The shipping cost is borne by the Service Provider, however, in the event of cancellation of the Order by the Customer, the Customer will be charged this cost.
- Collection of BigBag bags takes place according to the current schedule, available from the dispatcher at the telephone number 600 47 47 48
- In the process of placing an Order, the Client may express the will to receive a VAT invoice, which will be sent electronically to the e-mail address provided.
- Placing an Order constitutes consent to sending a VAT invoice in electronic form, in accordance with the Regulation of the Minister of Finance of December 20th, 2012, on sending invoices in electronic form, rules for their storage and the procedure for making available to the tax authority or tax inspection authority.
- If the buyer does not want to receive the invoice electronically, he may object — in this case, the Service Provider is obliged to provide the Client with the invoice in a traditional form.
- After the Client places an effective online order, he will receive an automatic reply from the store confirming the receipt of the order.
- All prices listed on the website http://dkm-odpady.pl/ are gross prices in Polish zlotys.
- The Client has the option to pay:
- payment via the TPay system (quick transfers),
- in cash or by card when delivering the container,
- via Blik,
- by bank transfer on the basis of a proforma invoice (for telephone orders).
§ 4. The right to withdraw from the Agreement
- The Order may be canceled at the latest on the day preceding the day of its execution.
§ 5. Complaints regarding the provision of Services
- The Service Provider has appropriate qualifications and authorizations to perform the works constituting the subject of the Agreement, and makes every effort to properly perform the Service.
- The Client is obliged to immediately notify the Service Provider of any irregularities related to the execution of the Order.
- Irregularities related to the implementation of the Order, as well as complaints, may be reported by the Client by e-mail to the address kontakt@dkm-odpady.pl
- In the complaint, the Client should provide his name and surname, contact details, date and place of irregularities related to the implementation of the Order.
- The Service Provider undertakes to consider each complaint within 14 days, and if it was not possible, to inform the Client during this period when the complaint will be considered.
§ 6. Changing the Regulations
- The Service Provider is entitled to amend the Regulations in the event of changes to the existing or adding new functionalities of the website, extension of the offer, other unforeseen circumstances, as well as in the event of a change in applicable law.
- In the event of a change or cancellation of any of the provisions of the Regulations by a decision of a competent authority or court, the remaining provisions shall remain in force and bind the Service Provider and the Client.
§ 7. Final provisions
- The data provided by Clients as part of placing the Order will be processed by the administrator - DKM Property Sp. z o.o. Sp. k.
- The Client has the right to access and correct the personal data provided, as well as to request deletion of data.
- The data is provided voluntarily, but failure to provide the data marked as mandatory may prevent the submission and/or execution of the Order.
- The administrator of personal data is DKM Property Sp. z o.o. Sp. k.
- The Client may additionally agree to receive advertising and commercial information from DKM Property Sp. z o.o. Sp. k. This information may be provided to the Client by means of electronic communication. Expressing consent is not a condition for the execution of the Order.
- Settlement of any disputes arising between the Service Provider and the Client shall be submitted to the court having jurisdiction over the headquarters of the Service Provider.
- In matters not covered by these Regulations, the provisions of the Civil Code and other relevant provisions of Polish law shall apply.
